They Agreed In Writing To Hide Their Writing

David Morens, who spent sixteen years inside the Office of the Director at the National Institute of Allergy and Infectious Diseases, pleaded guilty Tuesday to conspiracy to commit offenses against and defraud the United States. He is 78 years old and faces up to five years in federal prison.

Note what that is and what it is not. This is not an allegation, a referral, or a partisan committee's characterization. This is an admission, entered in federal court, by a man who was in the room for the entire American pandemic response.

Here is what he admitted.

Morens and his co-conspirators anticipated that their communications would eventually draw Freedom of Information Act requests. So they came up with a plan. They would move the sensitive material off official NIH systems and onto his personal Gmail account, where the public could not reach it.

And they agreed to this plan in writing.

Sit with that for a moment. A group of federal officials worried that their written communications would become public, and they addressed the problem by writing down their agreement to conceal their written communications. The Justice Department has now placed that admission in a plea agreement, which is, in fairness, a form of public disclosure they did not anticipate.

The Gmail account was then used for exactly what you would expect. Non-public NIH information. Coordination to influence the agency's funding decisions. Editing letters aimed at NIH leadership. Back-channel messages to a senior NIAID official. All of it constituted federal records the law required to be created and kept on government systems. That is the offense. Not having opinions about virus origins, which is legal, but running a shadow filing system so the taxpayers funding the work could never see it.

The underlying dispute was the terminated NIH grant supporting bat coronavirus research at the Wuhan Institute of Virology. Morens and his associates worked to get that funding restored and to push back against the possibility that COVID had come out of a laboratory.

Which brings us to the wine.

Morens also admitted to an illegal gratuities conspiracy. A co-conspirator gave him wine, described in the record as recognition for his behind-the-scenes shenanigans, which is their phrasing and not ours. Morens then went looking for an official act he could perform to deserve the gift. The act he selected was writing a scientific commentary for a prominent medical journal arguing that COVID had emerged naturally rather than from a lab. Additional benefits were on offer, including meals at Michelin-starred restaurants in Paris, New York and Washington.

Read that sequence again, because the order is the whole thing. The gift came first. Then he shopped for a justification. Then he published science.

For four years, Americans who wondered aloud about a laboratory in Wuhan were told they were spreading dangerous misinformation, that the consensus had spoken, that the published literature was settled. It turns out at least one contribution to that literature was produced by a man who was, on his own admission, working out what he owed somebody.

Two notes for conservatives inclined to run past what the record supports.

The senior NIAID official who received the back-channel information is not named in the plea. Neither is the co-conspirator. Speculate privately if you like, but a guilty plea this clean does not need embellishment, and embellishing it is the fastest way to make the story about you instead of about him.

Five years is also a maximum, not a sentence. Judges rarely impose maximums on 78 year old first-time defendants who plead out. Expect less, and do not let a lighter sentence be spun as proof the case was hollow.

The record stands on its own. Officials who wanted the public kept out built a system to keep the public out, and then documented it.

The paperwork always survives. It is the one thing a bureaucracy can never stop producing.
