On Wednesday morning, February 4, Federal Communications Commission Chairman Tom Wheeler proposed that the federal government reclassify the Internet – from an ‘information service’ to a ‘telecommunications service’ – in the name of keeping it “fair.” Of course, this is nothing more than a pass for Big Government to expand their regulatory power at the expense of digital freedom.

Like all innovation, the Internet wasn’t created by government… and government certainly has no power to control it. Nowhere in the Constitution is there a provision providing the federal government with power to regulate the free-flow of information. In fact, this whole idea flies in the face of the First Amendment.

Honorable [Senator, Representative] of the United States,

The federal government has no constitutional authority to regulate the Internet – in fact, the federal government is prohibited from such interventions by the First Amendment. If Congress “shall make no law” abridging the freedom of speech, with what power can the FCC do the same?

This said, I am outraged by Federal Communications Commission Chairman Tom Wheeler’s February 4, 2015 proposal to regulate the Internet like a public utility — a plan that came straight from Barack Obama’s desk — and personally urge you and your colleagues to oppose it.

The United States Senate and House of Representatives must defend the free and open Internet always.
